Legal Research
Ipsos Mendelsohn, established in 1958, is a highly respected, mid-sized full-service marketing, media and public opinion research company, with a specialty in conducting research for litigation purposes. In addition to being one of the Country's leading marketing and opinion research firms, Ipsos Mendelsohn has conducted over 300 surveys for potential litigation use, with most of them related to trademark issues, false advertising, and damage assessment issues.
Although the numbers of cases the firm has worked with attests to the organization's experience, it says nothing about the firm's philosophy regarding conducting this most challenging type of research. Ipsos Mendelsohn firmly believes that research intended to withstand the scrutiny of the National Advertising Division of the Better Business Bureau (NAD), the Trademark Trial and Appeal Board (TTAB), or a court of law must be designed and executed as fairly and objectively as possible without compromising its probative value. To this end, Ipsos Mendelsohn's research addresses the legal issues at hand without advocacy on our part. The firm has steadfastly positioned ourselves as "friends of the court," and not as witnesses for the plaintiff or defendant. Coupled with a true understanding of both intellectual property matters and research methodologies, this position has served our clients well.
Mr. McCullough, Chairman of Ipsos Mendelsohn, who leads the legal research practice is one of the Country’s leading experts in conducting legal research. Over the past 20 years, he has testified in numerous trials and other proceedings as an expert witness and has always been accepted as a survey expert.
Prior to joining Ipsos Mendelsohn in 1968, Mr. McCullough was a marketing research Group Head at Datatab, providing computer processing and statistical consulting services to marketing research companies, advertising agencies and advertisers.
Mr. McCullough has a BA in Psychology from Lafayette College and a MBA in marketing research from Baruch College of the City University of New York.
The firm's commitment to high quality research is a natural drawing card for law firms seeking objective primary research and an objective critique of research presented by opposing counsel. Projects that Ipsos Mendelsohn has conducted include:
- Trademark and Tradedress Issues
- Genericness
- Secondary Meaning
- Likelihood of Confusion
- Dilution
- Trademark Disparagement
- Advertising Communication and Comprehension
- Claim(s) Substantiation
- Breach of Contract Damage Assessment
